1. Agreement to Terms

By accessing or using YouCantSeeMeVPN ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

YouCantSeeMeVPN provides Virtual Private Network (VPN) services using the WireGuard protocol. Our Service allows you to:

• Connect to VPN servers in various global locations
• Encrypt your internet traffic
• Access the internet with enhanced privacy
• Bypass geographical restrictions (subject to local laws)

3. No-Logs Policy

We implement a strict no-logs architecture:

• RAM-Only Logging: All system logs are stored exclusively in RAM and are automatically wiped every 6 hours during scheduled system reboots
• No Traffic Logs: We do not log, record, or store any user traffic, browsing history, connection timestamps, or bandwidth usage
• No IP Address Logs: We do not store your original IP address or the IP addresses you visit
• Minimal Metadata: We only store the absolute minimum required for account management: email address and subscription status
• Payment Processing: Payment information is processed by Stripe and is not stored on our servers

This architecture makes it mathematically impossible for us to provide user activity data, even if legally compelled, because such data does not exist.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any applicable local, state, national, or international law
• Transmit malware, viruses, or harmful code
• Engage in illegal file sharing or copyright infringement
• Launch attacks on other networks or systems
• Send spam or unsolicited commercial messages
• Attempt to gain unauthorized access to computer systems
• Engage in activities that harm minors
• Conduct fraudulent activities

Violation of this policy may result in immediate termination of your account without refund.

5. Subscription Plans and Billing

5.1 Free Plan

Our free plan is ad-supported and provides limited access to US servers with community support only.

5.2 Paid Plans

Paid subscriptions are billed monthly in advance. All plans include a 48-hour free trial period.

5.3 48-Hour Free Trial

• New subscribers receive a 48-hour free trial period
• Payment information is required upfront but no charge is made during the trial
• You may cancel anytime during the 48-hour trial without being charged
• If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged
• The trial is available once per customer

5.4 Auto-Renewal

Subscriptions automatically renew each month unless cancelled. You may cancel at any time through your account dashboard or by contacting support.

5.5 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated at least 30 days in advance and will apply starting with your next billing cycle.

6. Refund Policy

Due to the nature of our service and 48-hour trial period:

• Trial cancellations within 48 hours: No charge, no refund needed
• Paid subscriptions: No refunds for partial months
• Service issues: Contact support for resolution; refunds evaluated case-by-case
• Cancellation: Takes effect at the end of your current billing period

7. Service Availability

While we strive for maximum uptime, we do not guarantee uninterrupted service. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We reserve the right to:

• Modify or discontinue any part of the Service
• Perform scheduled maintenance with or without notice
• Limit bandwidth or impose usage restrictions if necessary
• Change server locations or availability

8. Account Termination

We may suspend or terminate your account if:

• You violate these Terms of Service
• You violate our Acceptable Use Policy
• Payment fails or is disputed
• We receive legal requests requiring termination
• You engage in fraudulent or abusive behavior

You may terminate your account at any time through your account dashboard.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• YouCantSeeMeVPN is not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for data loss, business interruption, or loss of profits
• We do not guarantee that the Service will be secure, error-free, or virus-free
• You use the Service at your own risk

10. Indemnification

You agree to indemnify and hold harmless YouCantSeeMeVPN, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

11. Privacy

12. DMCA Compliance

We respect intellectual property rights. If you believe that copyrighted material is being infringed through our Service, please contact us with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury that the information is accurate

Note: Due to our no-logs architecture, we may not be able to identify specific users associated with alleged infringement.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except for disputes that may be brought in small claims court.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Material changes will be communicated via email to your registered email address.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
